Question by hammyscab: Is a doctor in fl required to report mild drug use to an underage patient’s parents? or is it a choice?
I will have surgery soon and apparently doctors tend to ask you if u have ever used drugs in the past 6 months and i would like to know if in the state of florida i can answer that question truthfully without having the doctor report it to my parents…Is there privacy rights for underage patients in florida?

It depends on the type of drug used for both if you can get away with a lie or weather he will tell if its weed and you haven’t smoked in at least 30 days then you can say no i haven but if its meth or worse it may still show up. if you are 17 then you still have rights under the doctor patient confidentiality act and no one may be told at all unless you are in the hospital for a drug related issue if you are younger the the doctor has the option of telling your parents but may not, especially if you tell him you just tried it and didn’t like it and will never do it again. but even if you were 5 years old the doctor patient confidentiality laws still prohibit him from telling anyone other than your parents about it without a legal warrant so if you give me some more information i can tell you exactly what to do
