California really took voters for a ride with this one. They promised that sex offenders, rapists, murderers, child molesters would fall under this category, but instead, they have small time robbers and drug users encarcerated when they should really be in rehab while Megan’s Law gets longer and longer. Tell me my fellow Americans, what are your views on this?

    I completly agree with you… it is one of the most flawed laws on the books, putting people in prison for life that don’t deserve to be there. Taking tax dollars to pay for prisons, that could better go towards programs aimed at reform and creating more preductive citizens!!

    I think there should definitely be a 3 strike system, and it
    should take into account the worst prisoners first and be
    more evenhanded, than before as for Megan’s law there
    should be set sentencing for those offenders, as they are
    the worst of them………………………………………………………..

    No rehab for those that kill, no matter what the circumstances
    unless it is someone who is abused or in self defence…………..

    First thing any sex offenders, rapists, child molesters should be a 1 strike your out. I hate saying this but in some murder cases like you go nuts and kill someone that killed your child should be considered under spend your time however long and get out. Any kind of robbing or stealing should be under the 3 strike law. Drug users is a little different but yes they should be under the 3 strike law to if they were offered rehab on the other 2 offenses.

    I think it should be three strikes for ANY ROBBERY DRUG, HOUSEHOLD ABUSE, law violation, the only thing is maybe a traffic offense but everything else put them AWAY for 20 + years, who needs them, get them off the street, besides for every three times they get caught they actually do the crime dozens of times and get away with it, so remove the trash!

    Oh yea, and molesters or rapist, put them away for life -with no chance for parole.

    The law should be applied equally to all period. If you commit 3 felonies your chances of rehabilitation are slim. You make it sound as though these people do not have a choice. They do, it’s called not being a criminal. As to drug rehab, the simple fact is that for it to work you must want to change your behavior, continuing to engage in destructive behavior does not show a will to change. Drug abuse is not a disease, it is a lifestyle choice. Like it says in the Baretta theme “Don’t do the crime if you can’t do the time”.

    Wow. I expected to see a lot more in support of your proposition here, and it’s surprising (though gratifying) to see that’s not the case.

    I have no problem at all with strikes one and two. Strikes are not handed out like candy. They are *generally* based on violent felonies, not things like jaywalking. In fact, twenty-four listed here:

    Are for particularly violent felonies. The remaining four are for drug offenses (one of those is for giving controlled substances like heroin and meth to a juvenile) and theft of a firearm (gee, wonder what they might do with that firearm?).

    All of which are seriously violent felonies. So far, I would hope that everyone would agree these are people that earn their strikes.

    The thing I object to is the third strike. It, I’m told, can be for *any* felony. This is the shoplifter or the bad check writer who goes to prison for life because it’s their third strike.

    And I think there are two arguments for this. On the one hand, you really had to earn those first two strikes – like I said, you didn’t get them for jaywalking. If you’re still not “getting it,” maybe locking you up for the rest of your life isn’t the worst idea ever.

    On the other hand, does a person really need to go to prison for the rest of their life, just because they stole a pack of gum? Probably not, but the law permits this strike not to be handled as one, to avoid that very problem.

    So my views are as follows:

    You’re wrong in what you said and in the way you said it. You would have people believe that sex offenders, rapists, murderers and child molesters aren’t being subjected to three strikes and I doubt you can prove that. You claim that “small time robbers” and drug users are being subjected to it, yet robbery is a serious violent offense…I can’t think of what a “small time” robbery would be. Drug *users* are not being subjected to three strikes because *using* drugs is not a felony, it’s a misdemeanor. Merely using drugs results in diversion, Prop 36, probation, and a host of other, weak-willed, half-hearted and generally ineffective “treatment” programs for those who don’t want treatment but would rather continue using drugs recreationally. You want to rail against something, rail against THAT bill of goods the voters were sold.

    And then, despite your intimated assertion that sex offenders and child molesters aren’t being subjected to three strikes, you go on to say that Megan’s Law gets longer and longer. How do you suppose that happens?

    And by the way – “California” didn’t take voters for a ride on this law. Other California voters, who wrote and presented this law, took voters for a ride.
